So, this last year I got divorced in March. my question is this. do I file as Married but not joint... or do I file as single? anyone know? (probably wont get my w-2s for a while but I want to know for sure so I can get my tax returns! if I do get one this year, :think: )

You need to file as single. It sucks, but the IRS only cares what your status is at the end of the year, and taxes you for the whole year accordingly. I went through the same thing a few years ago, but I didn't change my tax status to single until May of that year, so Jan - Apr I was paying at the married-1-income rate. I want to say I ended up owing something like $1,500. Hopefully that won't be the case for you, but do expect to have to pay (IF you were married-1-income; married-2-incomes is a higher tax rate that's much closer to the single rate). *edit* given the info above, November or December would be horrible months to split up, you'd end up potentially owing a fortune in taxes. Isn't the IRS fun?

thanx for your help. If I had gone a little farther into my tax prep I would have seen it. yeah def. dont get a divorce until jan -feb! at least I didnt end up owing anything. gonna have a nice refund this year. Esp. if I get the EIC for my son. dont remember how we set it up.
