A federal appeals court ruled Tuesday that the Federal Communications Commission lacks the authority to require broadband providers to give equal treatment to all Internet traffic flowing over their networks.

...crap... Well, here's hoping the FCC will appeal it. They've still got another level or two of courts to go through until they have to give up, I think.

Under current law they don't have he authority, I'm sure that could change in the future.

They're working on a bill that would give them the authority to enforce net neutrality, but if they lose this case it will likely weaken the case for it.
