Hey everyone,

Thought I'd create a little group for TBCS users on MySpace. I know. Myspace. Leave your nasty comments to yourself, please. I know many people use it and I thought that this would be a good way for people to get to know each other at a little bit of a more personal level.

Go to Myspace.com, just the home page. Click "Groups", and then on the left hand side, click "My Groups".

Or, you can log into MySpace and click "Home". On the right hand side, scroll down a bit and it'll say "My Groups".

To make it easier to figure out who is who on MySpace, I added [.M.] on the back of my name (standing for the periods in front and back of my TBCS name and the M for the first letter of it).

I think the mods might get a bit anyoed since they wern't notified first. Because we dont acuatlly manage or own the TBCS name and stuff Crimson does but meh I'm not they one who created the group.

If you had wanted to make a "Power Packed PC" myspace you could do that.

But you do NOT have ownership of "The Best Case Scenario" THAT is owned by Paul Capello (http://www.thebestcasescenario.com/index.php?module=htmlpages&func=display&pid=2) you are effectivley stealing his intellectual property and people will mistake you for the owner of "thebestcasescenario.com" which is Paul's Business. He's a published author.

I don't think you understand the problem. By being listed as the group leader it naturaly assumes that Tyler is associated with thebestcasescenario.com - He's NOT. He's just a guest here like you and me.

At the moment it looks like thebestcasescenario is based out of Doylestown PA and run by a 14 year old Vanilla Ice wannabe. I really doubt that, that is the image Paul wants for his business.

What if Tyler setup an "Orange county choppers" or "Steve Irwin: Croc hunter" myspace. Those titles assume association with an existing entity - its part of copyright laws. I can't start calling myself IBM or Coca-Cola and that's what he's doing here. Its not his name to assume.

Nowhere in this thread, prior to my post did Tyler (or anyone) say they had checked with Paul (or Rank, or Dave).

Rank and Dave both posted that they weren't interested in a myspace site but neither of them went any further to indicate approval or consent. That is why I posted my concern and as far as that goes, since Paul (Crimson Sky) hasn't actually posted his aproval, I'm going to asume he still hasn't given it. Furthermore, Dave and Rank are not listed as company contacts so I'm not sure if they have authority to speak on behalf of Paul regarding copyright issues. They are forum Mods. Rank is on the West coast and Dave lives in Scotland while Paul lives in Broklyn but I have no idea if they are involved in the day to day running of his business.

I have started, and been on the board of directors of, a C-corp (http://en.wikipedia.org/wiki/C_corporation) corporation (not an S-corp (http://en.wikipedia.org/wiki/S_corporation) or LLC). I have gone through the process of copyrighting a name and logo. It would seem Paul has done the same and even registered his and takes it seriously enough to post this at the bottom of the front page:

Now, I've said my peace on the subject.

I'm going to re-emphasise on this.

Cervinzol is correct in that we don't speak for Paul's business. When Tybrenis e-mailed me my reply was pretty much the exact same as what you said: "I don't speak for Paul's business, i'm only a mod. It's his choice, so e-mail him."

I'm sure he'd smile seeing how protective you are of this site and its 'brand name', but its time to relax in this issue. Tybrennis has been on this site for a long time, and he's contributed loads to the site. Now, if some little 3 post git had done it, we'd slam him. But it's not, it's a regular who we all know.

So Relax.

Hello everyone,

I apologize for not making it immediately clear. But to clear up any confusion, I spoke with Paul and:

- This MySpace group is perfectly fine with him
- He has given me the privilage of being the moderator, I offered him the spot and he declined
- Paul has given me permission and encouragement to use any site logos, etc.

I have also gone through the process of registering a corperation, logos, brand names, and DBAs. I would never act on this without having followed through properly with permissions.
